By completing the application to become a customer of the PRRD to purchase potable water from one of the 5 bulk water stations referred to as Buick, Prespatou, Fey Spring, Boundary, and Rose Prairie, or any future water station established by the PRRD in the water hauler agrees to the following:
- The water hauler acknowledges that the PRRD follows best practices in maintaining water quality standards as set by statute and regulation.
- The water hauler shall transport the water purchased from the PRRD in clean and sanitary containers suitable for transporting potable water and the water hauler will maintain such containers in such condition.
- The water hauler releases the PRRD and its elected officials, officers, employees and agents from any and all actions, claims, loss, damage, injury and liability, directly or indirectly relating to the PRRD’s sale of water to the water hauler or the existence of this Agreement.
- The residential water hauler shall not resell nor permit to be resold water purchased from the PRRD and agrees that such water is only for personal use.
- The water hauler vendor acknowledges that the use of the bulk water is for domestic/non-domestic use whereas the water hauler vendor shall distribute and sell water as provided for at the rate established by the PRRD. Delivery charges may be established by the water hauler vendor.
- The water hauler shall indemnify and save harmless the PRRD and its elected officials, officers, employees and agents from and against any and all actions, claims, loss, damage, injury and liability, including consequential and economic loss and bodily injury or death, arising directly or indirectly from the resale of water in contravention of this Agreement. The water hauler agrees this term shall survive the termination of this Agreement.
- The water hauler shall at all times be responsible for all damages cause to the PRRD’s water dispensing equipment during vehicle loading.
- At no time are water haulers permitted to dispense water from a PRRD bulk water station into a waste water or sewage hauling vehicle or vessel.
